The State Public Defender has adopted emergency rules to enact legislative changes effective on July 1, 2009. The emergency rules were implemented by the State Public Defender on September 15, 2009. The emergency rules provide that when the State Public Defender receives a claim for services provided from a Contract Attorney or a Non-Contract Attorney and the court failed to comply with the provisions of section 815.10, the State Public Defender will reject the claim.

Section 815.10 provides that where an application for court appointed counsel is filed by an indigent defendant, the court must appoint the public defender’s office designated to accept those types of cases. If the local public defender declines the case or no office has been designated for a particular case then the Court may appoint either a Contract Attorney or a Non-Contract Attorney. A Contract Attorney shall be given preference over a Non-Contract Attorney. To comply with the emergency rules, where a designation had been issued, the Court must make a finding in its appointment order that the designated public defender has declined or withdrew from the case prior to appointment of a Contract or Non-Contract attorney.

As of October 1, 2009 the State Public Defender has issued designation letters to each of the Clerks of Court of the State of Iowa specifying the designees and the cases designated.

Specific juvenile case designations are listed by county in the Juvenile Designation Chart for court appointments October 1, 2009 and after.

It is important that the courts follow the statutory designations as claims from private court appointed attorneys will not be paid unless the designation is followed. A financial affidavit and appointment order for adult and juvenile cases is provided.
